Terms of Service

1. Who you are contracting with

• These Terms of Service govern your use of forsalebypl.us and the For Sale By Plus service. The service is provided by ForSaleByPlus, LLC, a Florida limited liability company and Licensed Real Estate Brokerage in the State of Florida (License #BK3308391), located at 7901 4th St N, Ste 300, St. Petersburg, FL 33702.
• B3IP Holdings, Inc. owns the For Sale By Plus trademarks and underlying intellectual property and licenses them to ForSaleByPlus, LLC.

2. Eligibility

You must be at least 18 years old to use the service.

3. License to use the service

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose.

4. Prohibited uses

You may not misuse the service, including by: breaking the law; infringing others' rights; submitting false or misleading property information; scraping, reverse engineering, or interfering with the service; sending spam; or attempting to access accounts or data that are not yours.

5. Accounts

You are responsible for keeping your sign-in details secure and for all activity on your account. Provide accurate information and keep it current.

6. Purchases

Payments are processed by Stripe, which acts as merchant of record for card transactions. Stripe's terms govern the payment transaction, and refunds and taxes are handled according to those terms together with the service terms shown at checkout.

7. Your content

You keep ownership of the content you post or upload. You grant ForSaleByPlus, LLC a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the service so we can provide it. You are responsible for your content, and we may remove content at our discretion.

8. Real estate information

Home valuations, savings estimates, and market data are estimates for informational purposes only and are not appraisals. Listing data may be provided by a multiple listing service and is deemed reliable but not guaranteed.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

11. Indemnification

You agree to indemnify and hold harmless ForSaleByPlus, LLC, B3IP Holdings, Inc., and their officers and employees from claims arising out of your misuse of the service or violation of these terms.

12. Termination

We may suspend or end your access at any time if you violate these terms. You may stop using the service at any time.

13. Governing law and venue

These terms are governed by the laws of the State of Florida. Any dispute will be brought exclusively in the state and federal courts located in St. Johns County, Florida.

14. Changes and contact
